    सुप्रीम कोर्ट ने बिना इंश्योरेंस वाहनों पर ANPR से e-challan और ‘No Insurance, No Fuel’ pilot का निर्देश दिया है। जानें कार-बाइक owners पर असर।

    नई दिल्ली: अगर आपके पास कार, बाइक, स्कूटर या कोई दूसरा वाहन है, तो Vehicle Insurance पर सुप्रीम कोर्ट का यह आदेश आपके लिए बेहद महत्वपूर्ण है। सुप्रीम कोर्ट ने बिना वैध थर्ड-पार्टी इंश्योरेंस सड़कों पर चल रहे वाहनों के खिलाफ कार्रवाई को और सख्त बनाने के लिए technology-based व्यवस्था विकसित करने के निर्देश दिए हैं। इसके तहत Automatic Number Plate Recognition यानी ANPR कैमरों के जरिए वाहनों की पहचान, insurance records से verification और automatic e-challan की व्यवस्था की दिशा में काम किया जाएगा।

    कोर्ट ने इसके साथ ही insurance status को पेट्रोल-डीजल की बिक्री से जोड़ने वाले “No Insurance, No Fuel” pilot project को विकसित करने का निर्देश भी दिया है। हालांकि, इसका मतलब यह नहीं है कि आज से पूरे देश के हर पेट्रोल पंप पर बिना इंश्योरेंस वाहन को पेट्रोल मिलना बंद हो गया है। यह अभी pilot project के स्तर पर है।

    सुप्रीम कोर्ट ने वाहन इंश्योरेंस पर क्यों लिया सख्त रुख?

    यह मामला National Insurance Company Limited बनाम Smt. Thungala Dhana Laxmi & Others से जुड़ा है। सुनवाई के दौरान सुप्रीम कोर्ट के सामने देश में mandatory motor insurance के कमजोर अनुपालन का मुद्दा सामने आया।

    कोर्ट ने पाया कि कानून के तहत third-party insurance अनिवार्य होने के बावजूद बड़ी संख्या में वाहन बिना valid insurance के चल रहे हैं। इसी समस्या से निपटने के लिए Court ने insurance compliance को technology, vehicle databases और enforcement mechanisms से जोड़ने की दिशा में कई निर्देश दिए हैं।

    इसका उद्देश्य केवल uninsured vehicles पर चालान करना नहीं है। Motor insurance का एक बड़ा उद्देश्य सड़क दुर्घटना के पीड़ितों को compensation मिलने की व्यवस्था को मजबूत करना भी है।

    बिना इंश्योरेंस वाहन कैमरे से कैसे पकड़े जाएंगे?

    आने वाली व्यवस्था को आसान भाषा में समझें तो इसका तरीका कुछ ऐसा होगा:

    गाड़ी सड़क पर चली → ANPR कैमरे ने नंबर प्लेट पढ़ी → vehicle database से जानकारी मिली → insurance status verify हुआ → insurance valid नहीं मिला → e-challan की कार्रवाई।

    सुप्रीम कोर्ट ने Automatic Number Plate Recognition यानी ANPR cameras को insurance information और vehicle registration databases के साथ integrate करने की दिशा में व्यवस्था विकसित करने को कहा है।

    इसका फायदा यह होगा कि हर uninsured vehicle को पकड़ने के लिए traffic police को हर बार वाहन रोकना जरूरी नहीं रह सकता। Technology के जरिए vehicle insurance compliance की निगरानी ज्यादा automated हो सकती है।

    राज्य पुलिस को भी real-time insurance verification के लिए handheld devices या applications उपलब्ध कराने की दिशा में निर्देश दिए गए हैं, ताकि मौके पर ही वाहन का insurance status देखा जा सके।

    “No Insurance, No Fuel” क्या आज से लागू हो गया?

    नहीं।

    सुप्रीम कोर्ट ने सभी petrol pumps पर तत्काल nationwide insurance checking शुरू करने का आदेश नहीं दिया है। Court ने संबंधित authorities को consultation के जरिए एक pilot project तैयार करने का निर्देश दिया है, जिसके तहत valid third-party insurance को fuel supply से जोड़ा जा सकता है।

    यानी भविष्य में technology के जरिए यह जांच संभव बनाने की कोशिश होगी कि पेट्रोल या डीजल लेने वाले वाहन का mandatory insurance valid है या नहीं।

    इसलिए अगर सोशल मीडिया पर कोई यह दावा करता है कि “सुप्रीम कोर्ट के आदेश से आज से बिना इंश्योरेंस पेट्रोल मिलना बंद हो गया”, तो यह दावा भ्रामक होगा।

    अभी की स्थिति: No Insurance, No Fuel एक pilot project है, nationwide लागू नियम नहीं।

    16.54 करोड़ uninsured वाहनों का आंकड़ा क्या है?

    इस फैसले की खबरों में लगभग 56 प्रतिशत वाहनों के uninsured होने की बात प्रमुखता से सामने आई है। लेकिन इस आंकड़े को समझना जरूरी है।

    भारत सरकार ने 20 मार्च 2023 को लोकसभा में दिए जवाब में बताया था कि MoRTH से प्राप्त जानकारी के अनुसार देश का estimated vehicle fleet 30.48 करोड़ था, जिसमें 16.54 करोड़ वाहन uninsured थे। इस आंकड़े में मध्य प्रदेश, आंध्र प्रदेश और लक्षद्वीप का data शामिल नहीं था।

    लोकसभा का मूल सरकारी जवाब यहां देखें

    16.54 करोड़ को 2026 में uninsured वाहनों की नई सरकारी गिनती नहीं है। यह 2023 के सरकारी आंकड़ों पर आधारित संख्या है, जिसका सुप्रीम कोर्ट ने अपने मामले में संदर्भ लिया।

    उपलब्ध सरकारी आंकड़े 16.54 करोड़ को 30.48 करोड़ के मुकाबले करीब 54 से 56 प्रतिशत दिखाते हैं।

    Third-party vehicle insurance पहले से अनिवार्य है

    सुप्रीम कोर्ट के इस आदेश के बाद कुछ लोगों को लग सकता है कि वाहन का insurance पहली बार mandatory किया गया है। लेकिन ऐसा नहीं है।

    भारत में public roads पर चलने वाले motor vehicles के लिए third-party liability insurance पहले से अनिवार्य है। IRDAI की policyholder guidance में भी motor third-party insurance की अनिवार्यता स्पष्ट की गई है।

    IRDAI की आधिकारिक Motor Insurance जानकारी

    Motor Vehicles Act की Section 146 भी third-party insurance की अनिवार्यता से संबंधित है।

    इसलिए सुप्रीम कोर्ट के ताजा हस्तक्षेप का बड़ा हिस्सा नया insurance obligation बनाने के बजाय existing mandatory insurance की compliance और enforcement को मजबूत करना है।

    बिना इंश्योरेंस गाड़ी चलाने पर कितना जुर्माना है?

    Motor Vehicles Act की Section 196 के तहत बिना insurance वाहन चलाने पर मौजूदा कानून में पहली बार अपराध के लिए तीन महीने तक की imprisonment या ₹2,000 तक fine या दोनों का प्रावधान है।

    दोबारा अपराध होने पर तीन महीने तक की imprisonment या ₹4,000 तक fine या दोनों हो सकते हैं।

    India Code — Motor Vehicles Act, Section 196

    इसलिए अगर कहीं ₹10,000 के fine को तुरंत लागू नया नियम बताया जा रहा है, तो उसे सावधानी से पढ़ना चाहिए। Proposed changes और वर्तमान लागू penalty को एक जैसा नहीं माना जाना चाहिए।

    नई कार और बाइक खरीदने वालों के लिए भी बड़ा बदलाव

    Supreme Court के इस फैसले में नए vehicles के third-party insurance tenure को लेकर भी महत्वपूर्ण निर्देश हैं।

    नई private cars के लिए mandatory third-party insurance cover की अवधि 3 साल से बढ़ाकर 4 साल और नए two-wheelers के लिए 5 साल से बढ़ाकर 6 साल करने का निर्देश दिया गया है।

    इसका मतलब नई car या bike खरीदने वाले ग्राहकों के लिए mandatory third-party cover की शुरुआती अवधि पहले से लंबी होगी।

    लेकिन यहां एक जरूरी अंतर समझना चाहिए—third-party insurance और comprehensive insurance एक ही चीज नहीं हैं।

    क्या अब comprehensive insurance लेना जरूरी होगा?

    नहीं।

    सुप्रीम कोर्ट के इस आदेश का मतलब यह नहीं है कि हर car या bike owner के लिए comprehensive insurance mandatory कर दिया गया है।

    Mandatory requirement third-party liability cover की है। इसके अलावा own-damage, personal accident और अन्य अतिरिक्त covers अलग insurance protection दे सकते हैं।

    इसलिए vehicle owner को policy खरीदते समय यह देखना चाहिए कि उसके insurance में कौन-कौन से risks covered हैं और कौन से नहीं।

    सुप्रीम कोर्ट ने insurance policy को भी आसान बनाने की बात कही

    Court ने motor insurance products को ज्यादा स्पष्ट और consumer-friendly बनाने की दिशा में भी निर्देश दिए हैं।

    इसमें अलग-अलग insurance layers और customer को optional covers चुनने के लिए स्पष्ट विकल्प देने जैसी व्यवस्था शामिल है। इसका उद्देश्य यह है कि policyholder को यह समझने में परेशानी न हो कि उसने किस प्रकार का insurance लिया है और दुर्घटना की स्थिति में कौन-सा risk covered है।

    यह बदलाव खासतौर पर उन vehicle owners के लिए महत्वपूर्ण है जो केवल policy document में “insurance” लिखा देखकर यह मान लेते हैं कि उनकी हर तरह की vehicle damage automatically covered है।

    बिना इंश्योरेंस वाहन से accident हुआ तो क्या होगा?

    Mandatory third-party insurance का महत्व केवल चालान से नहीं जुड़ा है।

    यदि किसी uninsured vehicle से सड़क दुर्घटना होती है, तो accident victim या उसके परिवार के लिए compensation की प्रक्रिया ज्यादा मुश्किल हो सकती है। Third-party insurance व्यवस्था का एक प्रमुख उद्देश्य इसी financial liability को cover करना है।

    यही वजह है कि सुप्रीम कोर्ट ने uninsured vehicles की समस्या को केवल traffic violation के रूप में नहीं देखा, बल्कि road safety और accident victims के compensation से भी जोड़ा है।

    Vehicle Insurance enforcement में अब technology की भूमिका बढ़ेगी

    सुप्रीम कोर्ट के निर्देशों का सबसे बड़ा practical असर यही हो सकता है कि insurance checking धीरे-धीरे manual verification से technology-based enforcement की तरफ बढ़े।

    कल्पना कीजिए कि आपकी गाड़ी सड़क पर जा रही है और ANPR camera उसकी number plate पढ़ता है। यदि system vehicle registration और insurance database से जुड़ा हुआ है, तो vehicle का insurance status automatically verify किया जा सकता है।

    अगर insurance valid है तो कोई समस्या नहीं। लेकिन अगर mandatory insurance expired है, तो electronic enforcement mechanism के जरिए आगे कार्रवाई की जा सकती है।

    हालांकि यह व्यवस्था किस राज्य में कब और किस तरीके से लागू होगी, यह implementation के बाद ही स्पष्ट होगा। इसलिए इसे अभी हर शहर और हर सड़क पर लागू व्यवस्था मानना सही नहीं होगा।

    वाहन मालिक अभी क्या करें?

    अगर आपके पास car, bike, scooter या commercial vehicle है, तो सबसे आसान और जरूरी कदम है अपने third-party insurance की validity check करना

    अपनी policy में:

    • expiry date देखें;
    • vehicle registration number सही है या नहीं जांचें;
    • insurance certificate सुरक्षित रखें;
    • policy expire होने से पहले renewal कराएं।

    अगर insurance पहले ही expire हो चुका है, तो valid mandatory cover के बिना public road पर vehicle चलाने से बचना चाहिए।

    क्योंकि जैसे-जैसे technology-based enforcement आगे बढ़ेगा, insurance renewal भूलने वाले vehicle owners के लिए कार्रवाई से बचना मुश्किल हो सकता है।

    Vehicle Owners के लिए इस आदेश का सीधा मतलब

    अगर आपके पास गाड़ी है, तो फिलहाल इन पांच बातों को समझना सबसे जरूरी है:

    पहली बात: third-party motor insurance पहले से mandatory है।

    दूसरी बात: Supreme Court ने uninsured vehicles के खिलाफ technology-based enforcement मजबूत करने के निर्देश दिए हैं।

    तीसरी बात: ANPR cameras, vehicle databases और insurance information को जोड़कर automatic e-challan की व्यवस्था विकसित करने की दिशा में कदम उठाया गया है।

    चौथी बात: “No Insurance, No Fuel” अभी देशभर में लागू नियम नहीं है। इसके लिए pilot project तैयार करने का निर्देश दिया गया है।

    पांचवीं बात: नई private cars और नए two-wheelers के third-party insurance tenure में बदलाव किया गया है।

    गाड़ी है तो Insurance Status जरूर Check करें

    सुप्रीम कोर्ट के इस Vehicle Insurance Supreme Court Order 2026 का सबसे बड़ा संदेश यह है कि mandatory insurance की compliance को अब केवल कागजी औपचारिकता के रूप में नहीं देखा जा रहा है।

    ANPR cameras, vehicle databases और automatic e-challan जैसी technology के इस्तेमाल से uninsured vehicles की पहचान ज्यादा आसान बनाने की कोशिश की जा रही है। वहीं “No Insurance, No Fuel” pilot आगे चलकर लागू होता है तो vehicle owners के लिए insurance renewal को नजरअंदाज करना और भी मुश्किल हो सकता है।

    लेकिन फिलहाल यह याद रखना जरूरी है कि बिना insurance पेट्रोल पर nationwide रोक अभी लागू नहीं हुई है। यह pilot project के स्तर पर है।

    अगर आपकी car या bike का insurance expire हो चुका है या जल्द expire होने वाला है, तो policy की validity अभी check कर लेना सबसे समझदारी भरा कदम है।

    सड़क पर वाहन चलाना है तो valid third-party insurance सिर्फ कानूनी जरूरत नहीं, बल्कि दुर्घटना की स्थिति में financial protection की भी अहम कड़ी है।

    Vehicle Insurance 2026: अगर accident के बाद insurance claim reject हो जाए या insurer claim settlement में देरी करे, तो policyholder के पास शिकायत और grievance redressal के रास्ते मौजूद हैं। Vehicle insurance खरीदते समय Third-Party और Own Damage cover का अंतर समझना जितना जरूरी है, उतना ही जरूरी policy terms, exclusions, documents और claim process को जानना भी है।

    भारत में motor vehicle owners के लिए insurance सिर्फ एक financial product नहीं, बल्कि सड़क पर वाहन चलाने से जुड़ी महत्वपूर्ण legal और financial protection है। लेकिन ज्यादातर लोग policy खरीदते समय सिर्फ premium देखते हैं और policy की actual coverage, exclusions, deductible और claim conditions को नजरअंदाज कर देते हैं।

    मुश्किल तब शुरू होती है जब accident के बाद claim किया जाता है और insurer coverage, documents या policy conditions के आधार पर सवाल उठाता है।

    2026 में vehicle insurance policyholders के लिए सबसे जरूरी बात यही है कि policy खरीदते समय coverage समझें और claim dispute होने पर अपने grievance redressal rights का इस्तेमाल करें।

    Vehicle Insurance 2026 में सबसे जरूरी अपडेट क्या है?

    भारत में motor insurance से जुड़ा regulatory framework IRDAI के regulations के तहत चलता है। Department of Financial Services की official listing में IRDAI (Rural, Social Sector and Motor Third Party Obligations) Regulations, 2024 और Protection of Policyholders’ Interests Regulations, 2024 शामिल हैं। Department of Financial Services की listing जुलाई 2026 में updated है।

    इसका मतलब यह है कि Vehicle Insurance policyholder को सिर्फ policy खरीदने के बाद insurer के निर्णय को blindly accept करने की जरूरत नहीं है। Policy terms के अनुसार claim का assessment होगा, लेकिन अगर policyholder को लगता है कि complaint का सही समाधान नहीं हुआ, तो निर्धारित grievance mechanism का इस्तेमाल किया जा सकता है।

    Third-Party Insurance और Comprehensive Policy में क्या अंतर है?

    Vehicle Insurance लेते समय सबसे पहले यह समझना जरूरी है कि Third-Party Insurance और Comprehensive Insurance एक जैसे नहीं होते।

    Third-Party Insurance

    Third-Party policy का मुख्य उद्देश्य insured vehicle से किसी third party को होने वाली liability से संबंधित coverage देना है।

    उदाहरण के तौर पर, अगर किसी vehicle से किसी अन्य व्यक्ति या उसकी संपत्ति को नुकसान पहुंचता है, तो policy terms और applicable legal provisions के अनुसार third-party liability का मामला सामने आ सकता है।

    Comprehensive या Package Policy

    Comprehensive या Package Policy में Third-Party Liability के साथ policy terms के अनुसार अपने vehicle के नुकसान का Own Damage cover भी शामिल हो सकता है।

    यह coverage accident, theft, fire या अन्य covered risks से जुड़ी हो सकती है। हालांकि, हर policy में coverage और exclusions अलग हो सकते हैं।

    इसलिए “Comprehensive” शब्द देखकर ही policy न खरीदें। Policy document में actual coverage जरूर देखें।

    सिर्फ Third-Party Insurance होने पर अपनी गाड़ी का नुकसान मिलेगा?

    आमतौर पर Third-Party Liability policy का मुख्य उद्देश्य third-party liability को cover करना होता है। अपने vehicle के damage के लिए अलग Own Damage या package coverage की जरूरत हो सकती है।

    यही कारण है कि vehicle owner को policy खरीदने से पहले यह स्पष्ट रूप से देखना चाहिए:

    • Third-Party Liability cover है या नहीं?
    • Own Damage cover शामिल है या नहीं?
    • Accident damage किस सीमा तक cover है?
    • Theft या total loss की स्थिति में policy क्या कहती है?
    • Deductible कितना है?
    • कौन-कौन से exclusions लागू हैं?

    कई policyholders को claim के समय पहली बार पता चलता है कि जिस नुकसान के लिए वे claim कर रहे हैं, वह उनकी policy coverage में शामिल ही नहीं था।

    Vehicle Insurance Claim Reject हो जाए तो सबसे पहले क्या करें?

    अगर insurer claim reject करता है, तो policyholder को सिर्फ phone call पर मिली जानकारी पर निर्भर नहीं रहना चाहिए।

    सबसे पहले claim rejection का लिखित कारण मांगना चाहिए।

    Written communication में ideally यह स्पष्ट होना चाहिए:

    • Claim क्यों reject किया गया?
    • Policy की कौन सी condition लागू की गई?
    • कौन सा document या fact missing है?
    • कौन सा exclusion claim पर लागू किया गया?

    अगर rejection reason policy terms से मेल नहीं खाता या policyholder को लगता है कि decision सही नहीं है, तो insurer की internal grievance redressal process में complaint दर्ज की जा सकती है।

    मौखिक बातचीत की बजाय written record रखना ज्यादा उपयोगी होता है।

    Accident के बाद Claim के लिए कौन से Documents जरूरी हो सकते हैं?

    Claim की exact document requirement accident और policy terms पर निर्भर करती है। आमतौर पर policyholder से इनमें से कुछ documents मांगे जा सकते हैं:

    • Insurance policy details
    • Vehicle Registration Certificate यानी RC
    • Valid Driving Licence
    • Claim form
    • Accident की जानकारी
    • Police report या FIR, जहां आवश्यक हो
    • Repair estimate
    • Repair bills
    • Vehicle की photographs
    • Theft case में police documents

    हर accident में सभी documents जरूरी हों, ऐसा नहीं है।

    इसलिए insurer से claim process की exact requirement लिखित रूप में लेना बेहतर है।

    Claim Reject होने से बचने के लिए किन बातों का ध्यान रखें?

    Claim approval policy terms और incident की परिस्थितियों पर निर्भर करता है। इसलिए policyholder को ये गलतियां नहीं करनी चाहिए:

    Policy में गलत जानकारी देना

    Vehicle, owner, driver या vehicle usage से जुड़ी महत्वपूर्ण जानकारी गलत देना claim dispute का कारण बन सकता है।

    Accident की सूचना में अनावश्यक देरी करना

    Accident के बाद insurer को सूचना देने में देरी होने पर claim process प्रभावित हो सकता है। Policy में दिए गए notification requirements को देखना जरूरी है।

    Valid Driving Licence के बिना वाहन चलाना

    Driver के पास applicable और valid driving licence होना claim assessment में महत्वपूर्ण हो सकता है।

    Vehicle का गलत उपयोग

    अगर vehicle का उपयोग policy में घोषित उद्देश्य से अलग तरीके से किया गया हो, तो claim पर सवाल उठ सकते हैं।

    Accident के बाद बिना documentation के repair कराना

    Repair शुरू करने से पहले insurer की claim process requirements समझना जरूरी है। कई मामलों में survey या inspection की आवश्यकता हो सकती है।

    2026 में Insurance Claim को लेकर Consumer Rights क्यों महत्वपूर्ण हैं?

    20 जुलाई 2026 को आंध्र प्रदेश के Kurnool District Consumer Disputes Redressal Commission ने एक accidental death insurance dispute में insurer को ₹50 लाख का payout करने का आदेश दिया। Commission ने कहा कि policy जारी होने के समय मौजूद terms के बाहर claim के समय नई शर्तें थोपना उचित नहीं है। यह मामला motor insurance का नहीं था, लेकिन consumer protection के दृष्टिकोण से यह policy terms और claim settlement के महत्व को दिखाता है।

    इसका सीधा मतलब यह नहीं है कि हर vehicle insurance claim automatically approve होगा।

    Motor insurance claim का फैसला हमेशा संबंधित policy terms, exclusions, documents और accident की परिस्थितियों के आधार पर होगा।

    लेकिन policyholder को claim rejection का कारण समझने और उपलब्ध grievance mechanism का इस्तेमाल करने का अधिकार है।

    Claim अटक जाए तो Insurance Company के खिलाफ शिकायत कैसे करें?

    अगर claim या insurance service को लेकर समस्या है, तो पहला कदम संबंधित insurer की grievance redressal process में लिखित complaint दर्ज करना है।

    IRDAI के Bima Bharosa FAQ के अनुसार, policyholder को complaint लिखित रूप में supporting documents के साथ देनी चाहिए और complaint की written acknowledgement लेनी चाहिए। IRDAI के अनुसार, insurer को complaint पर निर्धारित समयसीमा में कार्रवाई करनी चाहिए।

    अगर policyholder insurer के resolution से संतुष्ट नहीं है या complaint का समाधान निर्धारित समय में नहीं होता, तो Bima Bharosa के माध्यम से complaint को आगे बढ़ाया जा सकता है।

    Bima Bharosa में Vehicle Insurance Complaint कैसे दर्ज करें?

    IRDAI का Bima Bharosa portal insurance policyholders के लिए grievance registration और tracking की सुविधा देता है।

    Complaint दर्ज करते समय policyholder को सामान्यतः ये details तैयार रखनी चाहिए:

    • Insurance company का नाम
    • Policy number
    • Claim number, अगर complaint claim से जुड़ी है
    • Complaint का पूरा विवरण
    • Supporting documents
    • Policy और claim से जुड़े जरूरी records

    Bima Bharosa portal पर complaint register होने के बाद token number के जरिए complaint को track किया जा सकता है।

    Bima Bharosa Complaint के लिए कोई Payment नहीं देना होता

    IRDAI ने policyholders को स्पष्ट चेतावनी दी है कि Bima Bharosa complaint registration या grievance resolution के लिए किसी भी तरह का payment नहीं मांगता।
