    पुलिस प्रशासन पर कॉपी पेस्ट के आरोप लग रहे हैं। कहा जा रहा है कि पुलिस प्रशासन के बीच ये कॉपी पेस्ट का कल्चर खतरनाक ट्रेंड बनता जा रहा है। इससे कानून व्यवस्था पर सवाल खड़े हो गए हैं।

    मुंबई: गवाहों के बयान और आरोपियों के जवाब एक दूसरे से मेल नही खाते। तब पर भी क्यों न्याय के लिए पीड़ितों को 19 साल का इंतजार करना पड़ा। मुंबई लोकल ट्रेन बम ब्लास्ट के मामले ने सैकड़ों निरपराध लोगों की जान ले ली और प्रशासन लीपा-पोती कर निर्दोष लोगों को जेल में ठूंस दिया। यहां तक कि कईयों को उम्र कैद तो कईयों को फांसी की सजा तक सूना दी गई। लेकिन आखिरकार हाईकोर्ट ने संज्ञान लिया तब जाकर फैसला सामने आया, कि पुलिस ने आरोप पत्र में गड़बड़ियां की हुई है और गिरफ्तार आरोपियों को सज़ा देने के लिए कोई भी ठोस सबूत नही है।

    मुंबई लोकल ट्रेन बम धमाका कोई छोटी मोटी घटना नहीं थी। इस घटना ने पूरे देश को झगझोड कर रख दिया था। लेकिन प्रशासन उन आरोपियों को पकड़ने में नाकाम हो गई और बेगुनाहों को बली का बकरा बना दिया गया। ये कैसी क्रूरता रही की उन निरपराध लोगों को 19 सालों का वनवास काटना पड़ा। इसकी जांच और दोषी अधिकारियों के खिलाफ कार्रवाई होनी चाहिए। जबकि सरकारी पक्ष भी कोर्ट में गलत साबित हुआ।

    कोर्ट में क्या हुआ?

    मुंबई ट्रेन बम ब्लास्ट मामले में हाईकोर्ट ने आरोपियों के इकबालिया बयान में समानता पर गंभीरता से गौर किया। कोर्ट ने कहा कि आरोपियों के बयान कई आधारों पर अधूरे हैं और सत्यता की कसौटी पर खरे नहीं उतरते। बॉम्बे हाईकोर्ट ने चार्जशीट में गवाहों के बयान में कॉपी-पेस्ट कल्चर पर चिंता जताते हुए इसे खतरनाक ट्रेंड बताया है। अदालत ने 2006 के मुंबई ट्रेन बम ब्लास्ट मामले में 12 आरोपियों को बरी कर दिया।

    अदालत ने क्या कहा?

    अदालत ने कहा कि गवाहों और आरोपियों के बयान अधूरे और असत्य पाए गए हैं और इनके कुछ हिस्से एक-दूसरे से हूबहू मिलते हैं, जो कॉपी-पेस्ट कल्चर को दर्शाते हैं। इसके साथ ही हाईकोर्ट ने मई और जून के मामलों में गवाहों के बयानों में कॉपी-पेस्ट पर संज्ञान लिया और महाराष्ट्र सरकार से इससे निपटने और इस संबंध में गाइडलाइन जारी करने को कहा।

    मई में हाईकोर्ट ने एक अन्य मामले में पुलिस की ओर से अमल में लाए जा रहे एक और खतरनाक कल्चर पर संज्ञान लिया था, जिसमें गंभीर अपराधों में भी गवाहों के बयान कॉपी-पेस्ट किए गए थे। अदालत ने तब कहा था कि गवाहों के बयान में कॉपी पेस्ट के इस तरह के कई मामले सामने आए है। पिछले महीने हाईकोर्ट ने एक अन्य आपराधिक मामले में भी इसी तरह के ट्रेंड पर संज्ञान लिया था और राज्य सरकार को इससे निपटने का निर्देश दिया था।

    सुप्रीम कोर्ट में मंगलवार को पति- पत्नी के बीच वैवाहिक विवाद में गुजारे- भत्ते को लेकर एक हाई प्रोफाइल केस आया। मुख्‍य न्‍यायधीश (CJI) भूषण आर. गवई की बेंच के सामने इस मुद्दे को लेकर दिलचस्प बहस हुई। आखिरकार सुप्रीम कोर्ट ने कई बड़ी टिप्पणियां कर फैसला सुरक्षित रख लिया। इस दौरान CJI गवई ने महिला को नसीहत दी कि वो पढ़ी लिखी है तो उसे पति के गुजारे- भत्ते के भरोसे नहीं रहना चाहिए। खास बात ये है कि महिला अपने केस की खुद पैरवी कर रही है।

    18 महीने की शादी में करोड़ों की डिमांड

    सुनवाई के दौरान मुख्य न्यायाधीश बी.आर गवई ने महिला से पूछा, ‘आपकी क्या मांग है?’ इस पर महिला ने कहा कि बस मुंबई वाला घर और 12 करोड़ रुपये का गुजारा भत्ता चाहिए। इस पर CJI  गवई ने कहा, ‘वह घर तो कल्पतरु में है। जो अच्छे बिल्डरों में से एक है और आप तो IT एक्सपर्ट हैं, आपने MBA किया है। जबकि बेंगलुरु, हैदराबाद नौकरी के क्षेत्र में आपकी डिमांड है!  कभी भी आप नौकरी शुरू कर सकती हैं तो आप नौकरी भी क्यों नहीं करतीं?’ उन्होंने यह भी कहा, कि ‘आपकी शादी सिर्फ़ 18 महीने चली और अब आप एक BMW भी चाहती हैं? 18 महीने की शादी और आप हर महीने एक करोड़ चाहती हैं।’ महिला ने जवाब दिया, ‘लेकिन वो बहुत अमीर आदमी हैं। उसने मुझे सिजोफ्रेनिया का शिकार बताकर शादी रद्द करने की मांग की।’

    कोर्ट ने मांगा आयटी रिटर्न

    खुद कमाकर खाइए

    CJI गवई मे महिला से कहा, ‘या तो आपको बिना किसी बोझ के फ्लैट मिलेगा या कुछ भी नहीं मिलेगा। जब आप उच्च शिक्षित हों और अपनी इच्छा से काम न करने का फैसला करें।या तो आप वो 4 करोड़ रुपये ले लें, पुणे/हैदराबाद/बेंगलुरु में कोई अच्छी नौकरी ढूंढ लें। आईटी केंद्रों में आप जैसी होनहार लोगों की मांग है।’ इस पर याचिकाकर्ता महिला ने शिकायत की, ‘मेरी नौकरी भी इन्हीं ने छुड़वा दी। मुझ पर FIR भी दर्ज करा दी।’ इस पर मुख्य न्यायाधीश गवई ने कहा, ‘आप FIR दे दीजिए, हम वो भी रद्द कर देंगे। हम निर्देश देंगे कि कोई भी पक्ष एक-दूसरे के खिलाफ कोई आपराधिक कार्यवाही शुरू नहीं करेगा।’ इस पर पति की वकील ने बताया कि ये तो समझौते में है ही। फैसला सुरक्षित रखते हुए CJI गवई ने महिला से कहा, ‘आपको खुद मांगना नहीं चाहिए बल्कि, आपको खुदको कमाकर खाना चाहिए।’

    अधिकारियों ने बताया कि जांच के दौरान सामने आया है कि वीमनी, वीएम ट्रेडिंग, स्टैंडर्ड ट्रेड्स लिमिटेड, आईबुल कैपिटल लिमिटेड, लोटसबुक, 11स्टार्स और गेमबेटलीग जैसे कई ऑनलाइन ट्रेडिंग और सट्टेबाजी प्लेटफॉर्म इस रैकेट में शामिल हो सकते हैं। इनमें से कई ऐप्स व्हाइट-लेबल तरीके से चलाए जा रहे थे यानी अलग-अलग लोगों को इन ऐप्स के प्रशासनिक अधिकार देकर मुनाफे में हिस्सेदारी दी जा रही थी।

    मध्यप्रदेश के इंदौर मे मामला दर्ज

    गौरतलब है कि यह मामला मध्य प्रदेश के इंदौर स्थित लसूड़िया थाने में दर्ज एक एआईआर पर आधारित है। हालांकि ईडी को कुछ हवाला ऑपरेटर्स और पैसों के लेन-देन से जुड़े लोगों की पहचान हुई है। उनके डिजिटल और वित्तीय दस्तावेजों की जांच की जा रही है।
